RE: GCF#02-31 David Van Dyke

Dear Mr. Davis:

This is to amend my complaint against VanDyke for the following breech of professional duties. VanDyke in case Docket No. CV01-153 in Cumberland Superior Court:

FAILED to designate Kenneth Moller, M.D. as an expert or as a witness for the trial that was recently held. Dr. Moller was the independent medical examiner hired and retained by Acadia Insurance Co. for the defendant that struck and injured me in an auto accident. His report, a copy is included, states on page two, "My impression is that Mr. Doyle has had an impingement syndrome secondary to the motor vehicle accident as described. ... he should be offered a surgical acromioplasty." The surgery and other prior treatment came to a cost of over $22,000.00 VanDyke's FAILURE to so designate Moller was the proximate cause of the jury verdict for the defendant, a copy is enclosed, and the loss of compensation for both my medical expenses and the attendant pain suffered during three and one half years of treatment.

I would ask the Board to take notice that defense counsel for Acadia was Peter DeTroy's firm and the ongoing relationship of VanDyke, Peter DeTroy, and a DeTroy sibling, Ben. The relationship may be the underlying reason that a pivotal witness was not included for my case and the subsequent harm done to me by VanDyke.
