October 2, 2009 Ms. Aria Eee, ABC File No. 09-229 Dear Ms. Eee: I request a review of your dismissal. Your interpretation of what Jack Simmons did not know strains even my jaded view of the Board's competence. After reading your letter it would seem that you believe Simmons never discussed his partner's, David Van Dyke's, handling of a security case that Simmons gave him from my phone call to Simmons. Also, that Simmons did not know his partner, Van Dyke, was being sued for malpractice. Also, that Berman & Simmons, the firm that has Simmons as a named partner did not know that his malpractice insurance carrier was employing Peter DeTroy to defend his firm. Also, Simmons was so out of touch with his own firm and Van Dyke's malpractice case that he did not know that his own firm's defense lawyer was the chief lawyer for the state against me. Also, that Van Dyke's statement, that he discussed my case every week with all the partners and they were all in agreement with him on his strategy, was not true. Is Van Dyke lying, or is Simmons claiming no knowledge of his collusion with Van Dyke and DeTroy a more plausible scenario or a bigger lie? Thank you, Michael Doyle |
